Один из инвестиционных продуктов, призванный привлечь институциональных американских инвесторов на криптовалютный рынок, был временно запрещен для торговли в США, сообщает CoinDesk. В воскресенье Комиссия по ценным бумагам и биржам США (SEC) выпустила распоряжение о временном запрете торгов цифровыми активами Bitcoin Tracker One («CXBTF») и Ether Tracker One («CETHF»). Время приостановки торговли продлится с «…17-30 9 сентября 2018 до 23-59 20 сентября 2018 года по североамериканскому восточному времени (UTC-4)».
Путаница и недопонимание
Основная причина, по которой финансовый регулятор вынужден приостановить торги — это путаница на рынке ценных бумаг. Цифровые активы Bitcoin Tracker One и Ether Tracker One выпущены в середине августа и стали доступны для торговли на Стокгольмской фондовой бирже Nasdaq Stockholm.
Финансовый инструмент Bitcoin Tracker One выпущен шведской компанией XBT Provider, дочерней компанией британской Global Advisors (Holdings) Limited. Этот неамериканский актив стал доступен для торговли американским брокерам и пенсионным счетам ввиду возможности его покупки за доллары.

В момент выхода ETN аналитик Том Ли радостно заявлял, что «…ETN действует подобно ETF, несмотря на разницу в структуре». Аналогичного мнения придерживалось и агентство Bloomberg. Такие комментарии и вызвали, по мнению регулятора, путаницу в головах неопытных инвесторов, приравнявших CXBTF и CETHF к ETF.
Время, в течение которого торговля ETN будет приостановлена, регулятор потратит на консультации и просветительскую деятельность среди дилеров и брокеров, связанных с рынком цифровых виртуальных активов. SEC заявила, что решение было принято в «общественных интересах» и что оно соответствует мандату Комиссии на обеспечение «защиты инвесторов». При этом регулятор опирается на нормы раздела 12 (k) Закона о ценных биржевых бумагах от 1934 года.
