Намерения опубликовать руководство по налогообложению криптовалют подтвердило Министерство финансов США. Об этом свидетельствует параграф в разделе «Налоговое администрирование» плана приоритетных для ведомства направлений работы в 2021-2022 годах.
«Правила, касающиеся предоставления информации о виртуальной валюте в соответствии с разделом 6045», — сказано в документе.
В плане на 2020 год был аналогичный пункт. Раздел 6045 налогового кодекса США касается отчетности брокеров. Раз в год традиционные биржи должны отправлять клиентам и в Налоговую службу заполненные формы 1099, которые содержат информацию о торговой активности. На криптовалютные платформы эти правила сейчас не распространяются.
До этого Минфин США планиров прояснить требования к налоговой отчетности криптовалютных компании (сообщал Bloomberg), но официального подтверждения этой информации не было.
Двухпартийный законопроект, направленный на обновление инфраструктуры Соединенных Штатов, содержит новые требования к отчетности участников индустрии цифровых активов. Он также расширяет определение «брокер» в налоговом кодексе США.
Подобные требования законопроекта в том виде, в котором они представлены, назвали технически неосуществимыми представители криптоиндустрии, в том числе Илон Маск и Джек Дорси.
