Финтех-компания Paymium требовала прекратить рассмотрение иска, в котором крупнейший провайдер биткоин-кошельков Blockchain обвинил её в нарушении торгового знака.
Он был инициирован в сентябре 2018 года. В иске утверждается, что созданная Paymium платформа blockchain.io умышленно вводит пользователей в заблуждение. Для этого используются элементы дизайна сайта Blockchain.com.
В феврале этого года Paymium подала ходатайство о прекращении иска
Представители компании утверждали, что аргументация истца недостаточна. По мнению Paymium, суд Нью-Йорка не имеет юрисдикции относительно её СЕО Пьерра Нойзата.
Из опубликованных документов суда следует, что ходатайство относительно прекращения иска по обвинению в нарушении торгового знака было отклонено. Поэтому иск Blockchain будет рассматриваться дальше. С доводами относительно СЕО Paymium Пьерра Нойзата суд согласился.
В оригинальном иске Blockchain утверждается, что blockchain.io создана в результате ребрендинга Instawallet для того, чтобы «спрятать концы в воду». Последний в 2013 году был взломан хакерами.
Суд согласился с утверждением Blockchain от том, что Paymium не подала в Комиссию по ценным бумагам и биржам США (SEC) заявление о намерении провести ICO. Руководство последней утверждало обратное. Так что данная часть иска будет рассматриваться и далее.
