SEC направила запрос в суд с требованием предоставить ведомству доступ к переписке сотрудников Ripple в мессенджере Slack. Информацию об этом сообщил адвокат Джеймс Филан.

Исходя из информации регулятора, сотрудники компании общались в равной мере в Slack и по электронной почте. Из-за этого Ripple необходимо предоставить SEC «более миллиона сообщений, включающих терабайты данных».
Также в прошении сказано, что в начале судебного разбирательства ответчики согласились предоставить ведомству эту информацию, но передали лишь 1468 сообщений. Последние, по утверждению SEC, содержали «критически важные и уникальные» данные.
Юрист Джереми Хоган уверен, что SEC подала запрос с целью доказать, что XRP является ценной бумагой. Также подчеркнул, что регулятор «добился определенного успеха с этим аргументом в прошлом».
The SEC has had some success with this argument in the past and it makes sense as a strategy since in all substantive ways XRP is NOT like a security. We will need to see Ripple's response before taking a gander as to whether the court will order production of the documents.

«Она [SEC] атакует с фланга, утверждая, что Ripple продавала и обращалась с XRP как с ценной бумагой, поэтому актив таковым и является», — отметил Хоган.
В ходатайстве SEC указано, что Ripple должна предоставить ответ в срок до 12 августа. Компания направила мировому судье Саре Нетберн просьбу о переносе дедлайна на понедельник, 16 августа.

Стороны также продолжили спор касательно привилегий совещательного процесса (deliberative process privilege) SEC. Этот принцип права позволяет регулятору отказаться от подачи документов и дачи показаний, сославшись на конфиденциальность данных и источников. Именно так Комиссия пыталась отклонить ходатайство Ripple о вызове в суд экс-директора отдела корпоративных финансов ведомства Уильяма Хинмана.
По словам Филана, «в ближайшие день-два» Ripple направит в суд восьмистраничное письмо с указанием своей позиции.
