Текущая версия законопроекта о регулировании криптовалют в США не имеет положения о невзаимозаменяемых токенах (NFT) и вопросах экологии. Информацию об этом сообщает сенатор США от штата Вайоминг Синтия Ламмис.
По ее словам, среди причин не включать NFT в документ стали сложности с их классификацией. Она надеется, что в будущем регулирующие органы придут к общему мнению по этому вопросу.
Благодаря этому законопроекту можно адаптировать правовую базу США таким образом, чтобы криптовалюты и традиционные активы попадали под одни и те же нормативные категории, подчеркнула Ламмис.
В частности, регулирующий документ разделит полномочия между CFTC и SEC. Под надзор первого ведомства попадут активы, которые считаются товаром и торгуются на спотовом или фьючерсном рынках, второго — относящиеся к категории ценных бумаг согласно тесту Хауи.
Вдобавок сенатор сообщила, что проект закона позволит использовать криптовалюты в платежах и интегрировать класс активов в пакеты накопительных пенсионных счетов 401(k). Ранее о планах предоставить клиентам подобную возможность заявили в Fidelity Investments.
Документ также затрагивает CBDC, но Ламмис отказалась уточнить детали.
Работу над этим проектом начали еще в декабре 2021 года.
