Заседание перенесено судом Южного округа Нью-Йорка. Следующие слушания по иску Комиссии по ценным бумагам и биржам США (SEC) против Telegram Open Network (TON) состоятся 18-19 февраля 2020 года.
Согласно распоряжению, ответчики не могут поставлять, предлагать или продавать токены Gram кому-либо до их завершения. Любой участник судебного заседания сможет внести ходатайство о том, чтобы ограничения были перенесены или сняты.
Telegram не согласился с позицией SEC
Представители компании заявили, что не нарушали закон. Gram, в отличии от контрактов на их приобретение, не являются ценной бумагой. В Telegram считают, что ограничение на распределение токенов является незаконным.
Запрет суда может быть превратно истолкован подписчиками закрытого размещения токенов и общественностью. Telegram уже согласился не принимать участие в деятельности, которую пытается ограничить SEC.
Регулятор не согласился с этими доводами. Его представители заявили, что отсутствие решения суда предоставит ответчику возможность в будущем нарушить закон. К тому же SEC придётся снова обращаться за вынесением предписания.
