Экспобанк оформил первый в РФ кредит, обеспеченный криптовалютой проекта Waves. Издание «Коммерсант» сообщает, что кредит оформили по типу банковской ссуды для предпринимателя Михаила Успенского.
Кредитная организация считает этот случай прецедентным как для юридического, так и для банковского сообщества. Выдали кредит по механизму условного депонирования (эскроу). Токены передали банку при помощи нотариуса, который также участвовал в сделке.
Юрист квалифицировал токены проекта Waves, как объекты «иного имущества», которые попадают действие гражданского права. И хотя сделка новаторская для ФР, но неплохо структурируется в рамках российского законодательства.
«Токены Waves можно вполне законно использоваться в РФ. В нашей стране нет ограничений на оборот неплатежеспособных токенов в нашей стране отсутствует», — говорит основатель компании LFCS Юрий Борисов.
Напомним, что в августе 2020 года Владимир Путин подписал закон «О цифровых финансовых активах». Он вступит в силу с 1 января 2021 года. Больше о законе мы рассказали здесь.
Также нужно сказать, что оформленная Экспобанком ссуда – не первый случай в практике РФ, когда в качестве залога использовалась криптовалюта. Но ранее подобные кредиты выдавали специальные компании. Например, p2p-платформа Biterest.
