После того, как биржа раскрыла информацию о своем клиенте по запросу ФБР, суд в США отнес Coinbase к традиционным банкам. Решение принято при рассмотрении апелляции Ричарда Гратковски, приговоренного к 5 годам и 10 месяцам тюрьмы за покупку запрещенных порнографических материалов с участием несовершеннолетних, сообщает Cointelegraph.
До этого в ФБР выяснили, что в период с июня 2016 года по май 2017 года Ричард Гратковски использовал BTC для покупки нелегального контента. Установив используемые им кошельки, ведомство обратилось в Coinbase с требованием раскрыть информацию об этом клиенте. Биржа выполнила это требования без решения суда.
Получив адрес Гратковски, ФБР провели обыск в его доме и обнаружили жесткий диск с запрещенными материалами. В ходе судебного процесса он оспорил обвинения, ссылаясь на Четвертую поправку конституции. По его словам, транзакции с участием BTC должны быть защищены точно так же, как информация о местоположении мобильного телефона.
Однако суд заключил, что криптовалюта не является неотъемлемой частью повседневной жизни, отметив, что прозрачность блокчейна Bitcoin сильно сказывается на приватности его пользователей.
Суд также постановил, что Coinbase является таким же финансовым учреждением, как и традиционные банки. Разница заключается лишь в том, что биржа работает с виртуальными валютами, а банки — с материальными.
