Верховная Рада Украины, 17 февраля, во время повторного рассмотрения приняла во втором чтении и в целом обновленный закон «О виртуальных активах». Он регулирует операции с криптовалютами на территории страны. “За” проголосовали 272 депутата.
Новый документ имеет все рекомендации президента Украины насчет регуляторов рынка ВА. На данном этапе не будет создан новый исполнительный орган власти, а из числа регуляторов исключили Минцифру.
Исходя из обновленного закона, государственное регулирование рынка виртуальных активов в пределах своих полномочий осуществляют Национальная комиссия по ценным бумагам и фондовому рынку (НКЦБФР) и Нацбанк Украины.
Функции НБУ: контроль за оборотом виртуальных активов, обеспеченных валютными ценностями.
Функции НКЦБФР: надзор за остальными виртуальными активами, а также обеспеченными ценными бумагами или деривативными финансовыми инструментами. Кроме этого – выдача разрешения и контроль за деятельностью поставщиков услуг, связанных с оборотом виртуальных активов.
Среди функций Нацкомиссии – определение порядка рассмотрения дел об ответственности за нарушение законодательства о ВА, в том числе введение финансовых санкций.
Согласно Конституции Украины президент должен подписать закон в течении 10 дней.
Закон начнет действовать после принятия парламентом изменений в Налоговый кодекс, касающихся налогообложения крипторынка. Когда это случится — неизвестно. Однако авторы законопроекта сообщили, что внесут соответствующий документ «на днях».
