Вчера офис Генерального прокурора Нью-Йорка (NYOAG) подал в Верховный суд штата доказательство того, что криптовалютные компании Bitfinex и Tether работали с жителями Нью-Йорка и прокуратура имеет право расследовать деятельность обеих фирм.
В поданном правоохранителями «Меморандуме о праве в участия в расследовании» содержится 28 эпизодов, в которых доказывается факт совершения компаниями бизнес операций на территории Нью-Йорка. Ранее адвокаты Bitfinex утверждали, что компания не ведет бизнес с клиентами из Нью-Йорка и, следовательно, не подпадает под юрисдикцию NYOAG.
В «Меморандуме» утверждается, что Bitfinex и Tether имеют несколько деловых контактов с бизнесом расположенным на территории штата. Отмечается также, что Bitfinex оказывал услуги жителям Нью-Йорка после того, как было заявлено о прекращении обслуживания нью-йоркских трейдеров в 2015 году. NYOAG предложила журналы IP пользователей Нью-Йорка в качестве доказательства.
«OAG получила дополнительные доказательства того, что торговая платформа Bitfinex была доступна нью-йоркским трейдерам даже в апреле 2019 года», – говорится в документах.
Прокуратура также предъявила переписку между Bitfnex и Galaxy Digital, хедж-фондом управляющим миллиардером Майклом Новограцем, о том, что он станет клиентом Bitfinex в октябре 2018 года. Кроме того Bitfinex имела счета в двух нью-йоркских банках – Signature Bank и Noble Bank и использовала их для перевода денег клиентов платформ Bitfinex и Tether.
Напоследок в «Меморандуме» затронута тема выпуска Bitfinex токена платформы обмена LEO, который, по мнению NYOAG, подпадает под действие закона Мартина и является ценной бумагой.
Напомни, пользователи твиттера предположили, что Bitfinex может манипулировать ценой биткоина при помощи Tether.
