Главный финансовый регулятор Японии — Агентство финансовых услуг (FSA) — разъяснил изданию Bitcoin.com как стабильные монеты трактуются действующим законодательством Японии. Регулятор утверждает, что стейблкоины не являются виртуальными валютами.
Криптовалютный рынок Японии регулируется измененными в апреле 2017 года Законами о фондах Японии и платежных услугах Японии. Первый определяет виртуальные валюты в качестве средства платежа и освобождает их от налога на потребление. Последний закон требует, чтобы операторы, торгующие криптовалютами, регистрировались в Агентстве финансовых услуг.
«В принципе, стабильные монеты, привязанные к национальным фиатным валютам, не относятся к категории «виртуальных валют» на основании Закона о платежных услугах» — уточнили в FSA.
FSA также пояснило, что «…из-за специфических характеристик [stablecoin] не всегда целесообразно, чтобы компании получали разрешение или регистрировались для выпуска стабильных монет».
Напомним, по мнению основателя Fundstrat Global Advisors Тома Ли стейблкоины представляют собой технически сложный эксперимент. При этом законодательная база под стабильные токены не урегулирована и эта тема станет одной из главных в 2019 году.
